Terms
1. About These Terms
These Terms and Conditions (“Terms”) govern your use of the Africa Automotive Analysis Limited (“AAA”, “we”, “us”, “our”) website, online portals, and vehicle inspection services. By booking an inspection, making a payment, or otherwise using our website or portals, you agree to be bound by these Terms. If you are acting on behalf of a company, dealership, clearing agent, or other organisation, you confirm that you have the authority to accept these Terms on that organisation’s behalf.
If you do not agree to these Terms, please do not use our services.
2. Our Services
AAA is an ISO/IEC 17020:2012 accredited inspection body and an accredited inspection partner of AutoTerminal Japan (ATJ). We conduct roadworthiness inspections of used vehicles imported into Zambia, assessed against the Zambia Standard for Used Motor Vehicles (ZS 560), and we work alongside the Zambia Compulsory Standards Agency (ZCSA) as part of that process.
A vehicle that passes inspection receives an inspection sticker and a Certificate of Roadworthiness. AAA assesses and certifies vehicles; we do not control, and are not responsible for, decisions, processing times, or requirements set by ZCSA or any other government authority.
3. Accounts and Portals
Where we provide an online account or portal, you agree to provide accurate and current information, keep your login details confidential, and notify us promptly if you suspect unauthorised use of your account. We may suspend or close an account used fraudulently, used to submit false information, or used in a way that breaches these Terms.
4. Agents
If you are booking an inspection, submitting documents, or making a payment as an agent on behalf of a vehicle owner, you confirm that you are authorised to act on their behalf, that the information and documents you submit are accurate, and that you will pass inspection results and certificates on to the vehicle owner promptly. Payments made by an agent are applied to the specific vehicle they were made for and are not transferable to another vehicle without our agreement.
5. Booking Information
You are responsible for the accuracy of the vehicle details, contact information, and supporting documents (including the commercial invoice and export certificate) you submit when booking an inspection. Inaccurate or incomplete information may delay your inspection, affect its outcome, or require you to resubmit documents, and AAA is not responsible for delays caused by inaccurate information you provide.
6. Fees
Inspection fees are charged per vehicle, in Zambian Kwacha, and are shown to you at the time of booking. Payment is required before inspection takes place. Fees for re-inspection are set out in our Refund and Cancellation Policy, not in this document.
AAA may update its fees from time to time; however, the fee shown to you at the time you make payment is the fee that applies to your booking, regardless of any later change.
7. Payment
We accept payment by mobile money (MTN Money, Airtel Money), Visa and Mastercard, and bank deposit. Cash payment is accepted only in limited circumstances at our discretion.
Card payments are processed by third-party payment providers; AAA does not store your full card details. Any bank charges, mobile money transaction fees, or currency conversion costs arising from your chosen payment method are your responsibility.
8. Refunds and Cancellations
Refunds and cancellations are governed by our Refund and Cancellation Policy, which forms part of these Terms. The inspection fee itself is not refundable where a vehicle fails inspection, since the inspection service has been performed; re-inspection terms are set out in that policy.
9. Results and Certificates
An inspection result and any Certificate of Roadworthiness we issue reflect the condition of the vehicle, assessed against applicable requirements, at the specific time of inspection only. An inspection is not a warranty or guarantee of the vehicle’s future condition or performance, and it does not guarantee that a vehicle will pass any subsequent inspection, including by another body.
Where a vehicle does not meet the applicable requirements, we will advise you of the identified defects. Re-inspection of a failed vehicle is handled under our Refund and Cancellation Policy.
10. Service Delivery
Inspections are carried out at our accredited inspection centres. Results, receipts, and certificates are delivered to you electronically. No physical goods are shipped to you as part of our services.
11. Notifications
By providing a phone number or email address when booking an inspection, you agree to receive service communications from us relating to your booking, payment, and inspection results, including by SMS, WhatsApp, or email. These are operational communications, not marketing, and are necessary for us to deliver the service you have requested.
12. Personal Information
We collect the personal information necessary to deliver our inspection services, and we share it where required with ZCSA, relevant government authorities, and our payment providers. We do not sell your personal information. We handle personal information in accordance with Zambia’s Data Protection Act, 2021, and our Privacy Policy, which forms part of these Terms. You may request access to, or correction of, your personal information by contacting us using the details in Section 18.
13. Acceptable Use
You agree not to misuse our website or portals, including by attempting to gain unauthorised access to our systems or another user’s account, submitting false or misleading information or documents, or engaging in fraud or any other unlawful conduct in connection with our services.
14. Availability
We aim to keep our website and portals available, but they may occasionally be unavailable due to scheduled maintenance or technical issues outside our control. Where our online payment systems are affected, we may offer an alternative payment method at our discretion.
15. Liability
To the fullest extent permitted by Zambian law, AAA’s total liability to you arising out of or in connection with these Terms or our services is limited to the fee you paid for the specific inspection service giving rise to the claim. We are not liable for indirect, incidental, or consequential losses, or for the acts, omissions, decisions, or delays of third parties, including ZCSA, other government authorities, or payment providers.
Nothing in these Terms excludes or limits any liability that cannot lawfully be excluded or limited under the laws of Zambia.
16. Changes to These Terms
We may update these Terms from time to time to reflect changes in our services, legal requirements, or operating practices. The version published on this page, together with its “Last updated” date, is the version that applies. We encourage you to review this page periodically.
17. Governing Law
These Terms are governed by the laws of the Republic of Zambia, and any dispute arising from them is subject to the exclusive jurisdiction of the courts of Zambia.
